1. Acceptance of Terms
By booking a tour, safari, or any travel-related service (collectively, “Services”) with Eselengei Safari Adventure (hereinafter “the Company,” “we,” “us,” or “our”), you (hereinafter “the Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
2. Booking and Payments
2.1. Booking: A booking is confirmed only upon our written confirmation and receipt of the required deposit.
2.2. Deposit: A non-refundable deposit of [e.g., 25-30%] of the total tour cost is required to secure your booking.
2.3. Final Payment: The full and final payment must be received by the Company no later than [e.g., 60 days] prior to the tour departure date. Failure to make full payment by the due date may be treated as a cancellation by the Client.
2.4. Payment Methods: We accept payments via bank transfer, credit card, or other methods as specified on our invoice. All prices are quoted in [e.g., US Dollars].
3. Cancellations and Refunds
3.1. Client Cancellation: All cancellation notices must be received in writing. Cancellation charges apply as follows:
More than [e.g., 60 days] before departure: Loss of deposit.
[e.g., 30-59 days] before departure: [e.g., 50%] of total cost.
Less than [e.g., 30 days] before departure: 100% of total cost (no refund).
3.2. Company Cancellation: We reserve the right to cancel a tour for reasons such as force majeure, insufficient numbers, or safety concerns. In such cases, a full refund of all monies paid will be issued, which will be the full extent of our liability.
4. Changes to Itineraries
While the Company endeavors to operate all tours as advertised, we reserve the right to alter itineraries, accommodation, or transportation at any time due to unforeseen circumstances such as weather, road conditions, wildlife movements, or political instability. Any significant changes will be communicated to the Client as soon as possible. Alternative arrangements of similar standard will be provided.
5. Client Responsibilities
5.1. Travel Documents: The Client is solely responsible for ensuring they possess a valid passport, necessary visas, vaccinations, and any other required travel documents for all countries included in the itinerary.
5.2. Travel Insurance: Comprehensive travel insurance is mandatory for all Clients. Insurance must cover cancellation, curtailment, personal injury, death, medical expenses, repatriation, and emergency evacuation.
5.3. Health and Fitness: The Client acknowledges that safaris can be physically demanding and may take place in remote areas. It is the Client’s responsibility to ensure they are medically fit and have disclosed any relevant health conditions to the Company.
5.4. Conduct: The Client agrees to abide by the authority of the tour guide and adhere to all safety instructions. The Company may terminate a Client’s tour, without refund, for dangerous or disruptive behavior.
6. Limitations of Liability
6.1. The Company acts as an agent for third-party suppliers (e.g., lodges, airlines, ground handlers). We are not liable for any loss, damage, injury, or expense caused by the act or omission of such third parties.
6.2. The Client participates in all activities at their own risk. Wildlife encounters carry inherent risks, and the Company is not liable for incidents arising from such interactions.
6.3. To the fullest extent permitted by law, the Company’s maximum liability to the Client for any claim shall be limited to the total cost of the tour.
7. Force Majeure
The Company shall not be liable for failure to perform its obligations if such failure results from circumstances beyond its reasonable control, including but not limited to war, threat of war, acts of terrorism, natural disasters, fire, pandemics, or government restrictions.
8. Privacy Policy
Any personal information provided by the Client will be used solely for the purpose of arranging and providing the booked Services. We will not share your details with third parties without your consent, except as required by our suppliers to fulfill the travel arrangements.
9. Complaints
Any complaint must be brought to the immediate attention of the Company’s local representative and the Company’s head office to allow for a swift resolution. If a complaint cannot be resolved locally, it must be notified to the Company in writing within [e.g., 30 days] of the tour’s completion.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Tanzania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.
